Common Reasons Work Permit Applications Have Problems
- Applying under the wrong work permit category.
- Missing or invalid job-offer, LMIA, or Employer Portal information.
- Employer documents that do not support the offered role.

- Inconsistent forms, dates, job duties, NOC selection, or salary information.

Important Work Permit Updates
- Family open work permits: since January 21, 2025, eligibility is limited to spouses of specified international students and foreign workers; dependent children of foreign workers are no longer eligible under those measures.
- Flagpoling: most people already in Canada can no longer obtain a new work or study permit through flagpoling and should apply through IRCC, subject to limited exemptions.
- PGWP applications: PGWPs can no longer be requested at a port of entry, and current language and field-of-study rules may apply.
- Changing employers: an employer-specific permit holder generally needs a new work permit, but eligible in-Canada workers may request interim authorization after applying.
- Maintained status: a person who applies before expiry may remain in Canada and may be allowed to work under the same permit conditions while IRCC processes the application.

Canada Work Permit FAQ
What is an open work permit?
It allows eligible holders to work for most employers in Canada, subject to restrictions printed on the permit and restrictions involving ineligible employers.
What is an employer-specific work permit?
It authorizes work according to stated conditions such as the employer, occupation, and work location.
Does every work permit require an LMIA?
No. Some employer-specific permits are LMIA-exempt, and eligible open work permits do not require an LMIA.
Can I apply for an open work permit without a job offer?
A job offer is generally not required, but you must qualify under a specific open-work-permit category.
Can I change employers with an open work permit?
Generally yes while the permit is valid, subject to any occupation, location, medical, or employer restrictions.
Can I change employers on an employer-specific permit?
You normally need to apply for a new employer-specific permit. Certain eligible workers in Canada may request authorization to start the new job while the application is processed.
Can I keep working after applying to extend my permit?
If IRCC receives an eligible extension application before expiry, you may be able to work under the same conditions while awaiting a decision.
What happens if my work permit expires before I apply?
You must stop working. Restoration may be possible within the applicable period, but restoration does not itself authorize continued work.
How early should I apply to extend?
IRCC recommends applying at least 30 days before expiry, although category-specific timing and required employer documents should be considered.
Can I flagpole for a work permit?
Most people already in Canada can no longer obtain a work permit through flagpoling. Only limited exemptions remain.
Does a work permit lead directly to permanent residence?
No. Canadian work experience may help under some immigration programs, but permanent residence has separate eligibility and selection requirements.
Can I study while holding a work permit?
Some short-term study may be allowed, but longer programs generally require a study permit unless a specific exemption applies.
Can my spouse receive an open work permit?
Possibly. Eligibility depends on the principal student’s program or the principal worker’s occupation and remaining permit validity, along with other rules.
Can dependent children receive family open work permits?
Dependent children of foreign workers are no longer eligible under the family OWP measures that took effect January 21, 2025, though they may qualify under another category.
Can I apply from outside Canada?
Many categories allow outside-Canada applications. The required process and documents depend on nationality, residence, work permit category, and job.
Can a visitor apply for a work permit inside Canada?
Only people who meet an in-Canada eligibility category may apply from inside Canada. Visitor status alone does not normally create eligibility.
Do I need a medical exam?
A medical exam may be required based on intended occupation, countries lived in or visited, and other immigration rules.
How long does processing take?
Processing varies by application type, location, completeness, biometrics, medical requirements, and IRCC workload.
Can a work permit be refused?
Yes. Officers assess eligibility, admissibility, documentation, employer compliance, and whether all legal requirements are met.
Can I reapply after refusal?
Yes, but the refusal reasons and weaknesses in the previous application should be addressed before filing again.
